Verbal Submissions – Remote Participation To make verbal comments to the Committee during the public portion of the hearing, please pre-register with the Secretary Treasurer by telephone or email by the date indicated on the Notice of Hearing. The Secretary Treasurer will provide you the Zoom link and password in advance of the meeting. This is for pre-registered participants only and is not to be shared with others. Zoom test meetings are available by request. Please advise the Secretary Treasurer of your requirements at the time of registration. Verbal Submissions – In-person Participation To make verbal comments to the Committee during the public portion of the hearing, please attend the hearing in-person at the date, time and location prescribed on the Notice of Hearing. In-person participants wishing to make verbal comments are encouraged to pre-register with the Secretary Treasurer by telephone or email. This allows for the preparation of a speakers list. Although pre-registration is encouraged and preferred it is not a requirement of speaking in person at the meeting. Please note, all verbal submissions, regardless of method, are live-streamed and recorded.
E-mail Comments Live While viewing the meeting remotely via livestream you may submit comments to: clerks@pelham.ca. Please note, comments must be received before or during the public portion of your application of interest. If your comments are submitted after the public portion of the application you are interested in has closed, your comments will not be considered. This method of public participation is not the preferred method as you may not submit your comments in time. Use this method at your own risk. The Town is not responsible for any livestream lag, disconnection or internet failures.
How Can I Receive A Copy of the Notice of Decision? If you provide written or verbal comments, you will automatically receive a copy of the Notice of Decision. If you do not provide written or verbal comments, and would like to receive a copy of the Notice of Decision, please contact the Secretary Treasurer, Sarah Leach, by mail or e-mail as stated above.

Committee of Adjustment Fees | ||||||||||||||||||||||||
Town of Pelham fees approved by Town Council: December 18, 2024. Payment is accepted via debit, cash or cheque made payable to the Treasurer, Town of Pelham.
Fees are established by the the Regional Municipality of Niagara for Regional Planning and Private Sewage System review fee(s), and the Niagara Peninsula Conservation Authority for NPCA review fee(s). The Town of Pelham has no jurisdiction over these fees and therefore, any questions on these particular fees should be directed to the appropriate agency. Such fees are subject to change.
There will be a minimum $35.00 fee on all cheques returned "Not Sufficient Funds". In this instance, further payment will be required by Certified Cheque, Money Order, or Cash only. This may result in a delay of the hearing. |

The Committee of Adjustment is comprised of five citizens appointed by Council to consider applications for minor variances to zoning by-law regulations and applications for consent (severances) under the Planning Act. The Committee of Adjustment meets once a month. Please refer to the hearing schedule(s) below:

Payment to Niagara Region
Payment to the Niagara Region can be provided to the Town, via cheque. This will be circulated to the Region with your application. Please address the payment to the Niagara Region.
Minor Variance Applications
A land owner who is unable to comply with the provisions of the Zoning By-law may apply to the Committee of Adjustment through a Minor Variance Application.
These minor changes to the Zoning By-law may be granted if, in the opinion of the Committee of Adjustment, the request is:
- Minor in nature;
- Desirable for the appropriate development or use of the land, building or structure;
- The general intent and purpose of the Zoning By-law is maintained; and
- The general intent and purpose of the Official Plan is maintained.
How do I apply for a Minor Variance?
A Pre-Application Discussion is required prior to submitting your minor variance. This process if free of charge and is arranged through the Planning Department.
A completed application form (link found below), the appropriate fee(s), necessary plans/drawings and a planning justification report/brief (if identified at pre-application discussion) are to be submitted. The application form details the exact information required on the Site Plan and the number and size of the plans required. If you have any questions on the nature of the relief from the Zoning By-law, please consult the Planning department.
Completed applications shall be submitted to the Secretary-Treasurer. Although electronic copies are both welcome and encouraged, original applications must be submitted in hard copy. Please note, the Secretary Treasurer is able to commission your application free of charge. An appointment is required for submission.

Consent Applications
Consent applications are required when a land owner wishes to sell, convey or transfer an interest of "part" of their land.
Consent is also required when the terms of an agreement, such as a lease, an easement or a mortgage commits the use of land for a period in excess of 21 years.
In addition to Consent, the Committee of Adjustment also has the power to issue a "Certificate of Validation" and to give "Approval of a Foreclosure of or an Exercise of a Power of Sale in a Mortgage or Charge".
How do I apply for a Consent?
Prior to consent application, all applicants are required to have a Pre-Consultation meeting with Town staff. This can be scheduled through the Planning department.
A completed application form (link found below), and the appropriate fee(s) are to be submitted along with a digital copy of a plan completed by an Ontario Land Surveyor. The application form details the exact information required on the survey. If you have any questions on how to complete the application form the Secretary-Treasurer is available to assist.
